The Perpetual Electronic Lineup

SUBHEAD: As an adult American chances are better than 50% your in the FBI facial recognition database.

Image above: Sample of "new' Hawaii driver's license introduced in 2010 to meet federal regulations permitting it to be used for security clearance situations like boarding an airplane, an international identity check or for the federal facial recognition database. From (http://the.honoluluadvertiser.com/article/2010/Jan/30/ln/hawaii1300331.html).

Half of American adults are in a face-recognition database, according to a Georgetown University study released Tuesday. That means there's about 117 million adults in a law enforcement facial-recognition database, the study by Georgetown's Center on Privacy & Technology says.

"We are not aware of any agency that requires warrants for searches or limits them to serious crimes," the study says.

The report (PDF), titled "The Perpetual Line-up: Unregulated Police Face Recognition in America," shows that one-fourth of the nation's law enforcement agencies have access to face-recognition databases, and their use by those agencies is virtually unregulated.

"Innocent people don't belong in criminal databases," said Alvaro Bedoya, the executive director of the Center on Privacy & Technology and co-author of the study.

"By using face recognition to scan the faces on 26 states' driver's license and ID photos, police and the FBI have basically enrolled half of all adults in a massive virtual line-up. This has never been done for fingerprints or DNA. It's uncharted and frankly dangerous territory."

Where do the mug shots come from?

For starters, about 16 states allow the FBI to use facial recognition to compare faces of suspected criminals to their driver's licenses or ID photos, according to the study. "In this line-up," the study says, "it's not a human that points to the suspect—it's an algorithm."

The study says 26 states or more allow police agencies to "run or request searches" against their databases or driver's licenses and ID photos. This equates to "roughly one in two American adults has their photos searched this way," according to the study. Many local police agencies also insert mug shots of people they arrest into searchable, biometric databases, according to the report.

According to the report, researchers obtained documents stating that at least five "major police departments," including those in Chicago, Dallas, and Los Angeles, "either claimed to run real-time face recognition off of street cameras, bought technology that can do so, or expressed an interest in buying it."

The Georgetown report's release comes three months after the US Government Accountability Office (GAO) concluded that the FBI has access to as many as 411.9 million images as part of its face-recognition database.

The bulk of those images are photographs of people who have committed no crime. That study, which provided examples of crimes solved by using the database, noted that the FBI database was used in investigations involving credit card and identity fraud, bank robberies, violent crime, and other felonies.

Meanwhile, the Georgetown study also said that police departments have little oversight of their databases and don't audit them for misuse:
Maryland's system, which includes the license photos of over two million residents, was launched in 2011. It has never been audited. The Pinellas County Sheriff's Office system is almost 15 years old and may be the most frequently used system in the country. When asked if his office audits searches for misuse, Sheriff Bob Gualtieri replied, “No, not really.” Despite assurances to Congress, the FBI has not audited use of its face recognition system, either. Only nine of 52 agencies (17%) indicated that they log and audit their officers' face recognition searches for improper use. Of those, only one agency, the Michigan State Police, provided documentation showing that their audit regime was actually functional.
Clare Garvie, the report's lead author, sent records requests to 100 police departments. Only half of them acknowledged using facial recognition. Many of the agencies allow police to search for someone regardless of whether he or she is suspected of a crime.

"With only a few exceptions, there are no laws governing police use of the technology, no standards ensuring its accuracy, and no systems checking for bias" Garvie said. "It's a Wild West."

The End Game begins?

SUBHEAD: Either you position yourself before the skies darken or you are left groping in the dark.

By Cognitive Dissonance on 30 May 2016 for Two Ice Floes -
(http://twoicefloes.com/where-will-you-be-when-the-end-game-begins/)

Image above: Chess strategies of the End Game. From (http://www.thylacine3.com/419536821).

Sometime after oh-dark-thirty it will begin, the previously cocked trigger suddenly released to wreck havoc throughout the world’s financial system. Like an intricate and interwoven design made entirely of standing dominoes, all it takes is a slight disturbance to knock one off its base and start the cascade of toppled consequences running down the line.

With the benefit of hindsight it will be seen that the trigger itself was not the killer. Instead, sometime later, a specific projectile will be (most likely falsely) identified as the blunt instrument which tore economic flesh asunder and quickly bled the system of ‘liquidity’ faster than a slash to the femoral artery. Too late to make a difference, tourniquets will be applied to stem the red tide.

Sadly, all it will accomplish is to extend economic life long enough to enable a final frenzy of looting before the bloody end.

And the totalitarian end game will have only just begun.

End Game
Where will you physically be when the end game begins? If you are not there when it begins, you will most likely never get there.

A socioeconomic system, if healthy and vibrant, can usually withstand extremely rough handling and even intentionally directed assault. A severed lifeline, while certainly a devastating shock to the organism, can and will be survived simply because adequate resources and flexibility remain within the structure which can be quickly marshaled while emergency repairs are made.

But a compromised entity already deathly ill, continuously pumped with toxic drugs and stimulants, stressed beyond compare by various Rube Goldberg financial devices, constantly monitored and regulated to assure compliance to artificial standards no natural system would ever adhere to, is always one disturbance away from disaster.

Thus the stage is set for the dark thirty triggering event.

While several likely scenarios can be put forward regarding the sequence of events that might follow the triggering (as well as the trigger itself) the precise chain of events is ultimately of little importance since a million and one fingers are resting on the trigger and several trillion dominoes await their inevitable fall.

The socioeconomic weapon will be fired, of this there is little doubt. The more penetrating, and ultimately personal, question is of what intensity and duration are the intended consequences.

I sincerely fear a long term mass casualty event of such strength and scope as to be inconceivable, therefore impossible, for the average cloistered mind to comprehend. Even those of us presently reading this article believe we have a heightened, some might say enlightened, perspective and understanding of the coming trials and tribulations.

We do not. And quite frankly, we cannot.

I say this with great conviction by way of my interaction with, and study of, living examples...those who lived through and carried the lifelong scars of the Great Depression of the 1930’s.

While just about any American over the age of 60 has talked to, or heard stories of, older family members who survived that decade plus of sustained hardship and deprivation, as a financial planner and broker I worked directly with many who suffered the most in the area of greatest damage, their personal financial affairs.

The best way to describe this class of people, an entire generation in fact, is that of walking wounded who are deeply scared by post traumatic stress disorder (PTSD).

More than ‘just’ suffering from the effects of a horribly maiming bomb blast, these survivors carried the burden of having been completely demoralized and abandoned by every institution they ever came to believe in.

Seventy plus years after the fact, the remaining few still hold little trust in anything they cannot hold in their hands or create with their own sweat and blood.

Talk about a lost generation.
Thankfully for the powers-that-be who presently guide us into dark territory, that generation, along with its vivid memories and stark warnings, is rapidly dying off. There is nothing more annoying than attempting to run the train off the tracks while those in the back seats are rabble rousing with dire warnings of impending doom, death and destruction. Into the valley of death rode the 6 billion.

As they say in poker, this nearly extinguished generation is a ‘tell’, a sign, a marker unmistakably warning in no uncertain terms where we are headed is not where we want to be.

This alone should be sufficient for any critical thinker to settle his or her affairs and remove themselves from the clearly marked ground zero, your local (sub) urban center where any semblance of independence and self sufficiency is a pipe dream of the self deluded mind.

It is well past time to move to where we have a chance of regaining some (even limited) control over our food, water and (safer) space.

Time is running out
Time is not on your side. When exactly do you posittion yourself for the next phase of Empire's collapse?

This is not to say we should bunker in, both physically and mentally. In fact I speak of just the opposite. As I have expressed time and time again, while bunkering might tide us over nicely for a short duration event of a few months or even a year, at some point we must come up for air and interact with the local population.

If at that point we have not integrated ourselves into the community, an extremely unlikely event if we were actually bunkering, it will be exponentially more difficult to do so after the fact. At best, if we are seen as a threat they will shun us and leave us to our own devices.

At worst we will be treated as a dangerous nuisance animal that must be eliminated or neutralized for the community’s greater good.

If the community, already dealing with great stress and turmoil, finds ‘us’ of less value than our ‘stuff’, they will take our stuff and leave our rotting carcass behind. We will be outsiders and must prove our worth to the others.

In a devolving socioeconomic situation a cohesive community must work together as equals while providing similar and equal value to the whole in order to survive. Those alien to the area will be quickly cast off if they do not measure up.

But there is more, so much more, to the unfolding totalitarian equation. One must be willingly deaf, dumb and blind not to hear the propaganda on the boob tube, understand the game theory being played out and see the bleak writing on the wall.

Any oppressive and controlling regime, whether it is defined as the elite, the one percent, shadow government, deep state, corpocracy, fascism or whatever label we use to mindlessly identify, compartmentalize and thereby cognitively diminish, will use any and all means at its disposal to defend itself when it perceives itself under attack.

And the term ‘attack’ is loosely defined to encompass any perceived danger real, imaginary or falsely concocted.

To view the increasingly hostile police state which America is rapidly becoming as anything other than an oppressive and controlling entity readying itself for war upon its population is to expose the reader’s appalling denial of the glaringly obvious. This is nothing short of an emotional and intellectual defect that is severely debilitating and potentially terminal.

The danger is clear and present and growing on a daily basis. If this cannot be seen for what it is, the observer remains hopelessly mired in the bargaining phase of their denial.

Then again never underestimate the time, energy and effort seemingly intelligent and worldly people will invest in constructing an alternative reality they wish to believe in. As a corollary, never underestimate the time, energy and effort an oppressive and controlling regime will invest in promoting an alternative reality the population wishes to believe in.

A self deluded populace is more easily controlled and directed than one whose sticks and stones, when used in anger, may break the elite’s bones. If the population wants to believe in fairy tales, give them fairy tales they can love, honor, cherish and defend. If they don’t, convince them they should believe by any means possible.

The genius of those who are constructing the underlying superstructure of the police state is their cunning ability to do so under the unflinching glare of the midday sun. Problem, reaction, solution is their trade craft, the government bureaucracy their blunt instrument, a corrupted legislature the enabler and creator of the unconstitutional and immoral laws, a co-opted and controlled press their sympathetic choir and the judiciary the final fraudulent arbiter of the chains that bind.

Make no mistake about it, every ‘government’ at war with its people makes certain its actions are ‘just and lawful’, particularly when they are patently not.

When viewed from the point of view of the disinterested and detached, the inevitable is obvious. The only purpose for power is to use the power…or have it used against its own creator. Therein lays its absolute ability to corrupt absolutely.

Clearly the rapidly increasing capacity of the powers-that-be to surveil, subvert, suppress, subdue, subsume and slaughter is self evident to all but those who are desperate not to see. Or, in what is more likely the case, are either paid not to see or wish to continue to be paid if blindness is feigned and cooperation assured.

See No Evil
The Empire demands compliance. Why would you possibly think your 'End Game' options will still exist when the End Game begins?

This is why, at least at this moment, we would not be able to strike directly at the heart of the diseased beast, for it will be our fathers, family and friends who will defend ‘it’ from us. The Empire is exquisitely designed and constructed to be empowered when physical force is used against it.

Both the physical structure of its ramparts and the perverted psychology of its defenders are strengthened and emboldened when physical force is applied. Active resistance, when directed towards the Empire, is our own worst enemy.

The only way physical force has any chance of working against the Empire is when applied in overwhelming numbers against all vulnerable borders on a continuous basis. Since this requires great sacrifice by the population at large, Jane and Joe will only turn to these devices as a last resort, when all hope is lost and abject desperation sets in.

Even then, the controlling elite are expert at employing propaganda and psychological operations to turn Jane against Joe, thereby minimizing the effectiveness of the opposing force. One must be competently conditioned to kill on command in great numbers with ruthless efficiency to be considered an effective fighting force.

Quite frankly an angry mob is the exact opposite, making it very easy to turn each upon the other since the only driving force of the mob is blind emotional outburst easily subverted and misdirected.

Below are some sobering thoughts to ponder regarding human psychology and armed resistance to the Empire.

Organized revolution requires both the will and a way. And by ‘way’ I mean money. Any money procured by, or offered to, a resistance always comes with strings attached. Often the money comes directly from the controlling elite itself via back channels designed to subvert, misdirect or implode the resistance.

Or it might come from an enemy of the Empire, thereby making you a proxy and not an independent force. Someone’s bitch, plain and simple.

Essentially, when outnumbered and outgunned guerrilla tactics are usually employed. Basically you are fighting fire with even more devastating fire. If you have any moral qualms with using the methods of Empire against the Empire, this fight isn’t for you. To convince yourself otherwise will only destroy you from within.

If you aren’t ready to declare war on your community, don’t even consider this path. Ninety percent of the population is hopelessly compromised, whether spiritually, morally, medically or pharmaceutically, psychologically, financially or ideologically. To believe otherwise is to engage in self deception. The vast majority will never oppose the Empire in any consistent or meaningful way.

Even worse, in the words of Morpheus, “You have to understand. Most of these people are not ready to be unplugged. And many of them are so inured, so helplessly dependent on the system that they will fight to protect it.”

This is so much more than a quote from some silly Hollywood movie. This is a universal psychological truth used to the significant advantage of the Empire. While the puppeteers are a relative few, they leverage the minds of millions far more effectively than if the bodies were simply cannon fodder.

Any serious degradation or collapse of the system will not weaken, but rather strengthen, the Empire, if only because it is accelerating the endgame towards the present day. Those compromised by the system will beg the corrupt system to save them from the collapsing system, a fool’s errand vigorously pursued by unprepared and panicked fools along with the ever present groveling sycophants.

Desperate men do desperate things. Our mistake is assuming that when the downward spiral accelerates the core elite will be among the desperate. Those pursuing a plan of divide and conquer while reaping the spoils will not panic when it’s playing out as expected. Socioeconomic chaos is their friend, not yours or mine.

While the endgame may be accelerating, it will not conclude quickly. These long period cycles of madness require many years, even decades, to complete its rotation only to begin the cycle once again.

Since the insanity of a decaying and corrupt Empire is constantly renewed and invigorated by new blood from below, its lifespan is far longer than yours and mine. The name of the game is survival, not gloriously wasted death or indefinite incarceration.

The greatest danger to us and our loved ones is not (just) the violent thrashing of the expiring Empire, but our refusal to deal frankly and honestly with our own personal shortcomings and denial. Our unwillingness to soberly assess ourselves and our surroundings circumvent any proactive response by us to a worsening situation.

To think one can shelter in place within the confines of the corral is shear lunacy. To believe one can effectively time their escape to greener pastures just ahead of the initial imposition of the financial lockdown is not dealing with reality, other than one produced by the self deceived.

The reason most of us remain frozen in place like jack-lighted deer is our reluctance to recognize the severity of our situation and the capacity for further degradation. Quite frankly, this reduces us to little more than rationalization and justification to explain our near total inaction, other than possibly stockpiling.

Ultimately our ‘plan’ is to cheer on a systemic collapse in the hope those in power will be deposed and a new regime arises from the ashes to rebuild the Empire from the tattered remains of its glorious capitalist past.

At best this is wishful thinking, at worst suicidal. There is madness afoot, a debilitating energy that permeates all that lives, not just the ‘bad’ guys and gals. In the vast majority it expresses as obsessive compulsive behavior, in some it manifests in the form of a sociopath or psychopath, with others various combinations of the seven deadly sins (greed and pride/ego especially) rise to the surface, in still others fear and cowardice prevails.

Great personal and collective courage is required to overcome the disaffected ‘self’. And during times of mass delusion and hysteria, courage is in chronic short supply.

Courage
Do we wait for the water to boil or make our move now? Our biggest enemy is not our surroundings, but our 'self'.

I am fully aware all that is necessary for the triumph of evil is that good men do nothing. I do not propose nothing be done. But the choices are not limited to either charging directly into withering rifle fire or remaining huddled behind phantom cover in the hope we survive. There are many equally viable alternatives, including (at least partial) withdrawal to begin the process of starving the beast.

Make no mistake about the following. The power of the Empire has not yet waned to the point where it will be toppled by its own arrogance, hubris or blind greed. It has miles to go, and lives to destroy, before it sleeps. Any weakness displayed by the Empire will be compensated for by even greater transgressions against the population.

The lie we tell ourselves is we are not participating in strengthening the Empire by simply going about our daily business while drafting, and possibly even implementing, contingency plans A, B and C.

The Empire cares little about the plans of individual mice and men. So in this respect the illusion of safety within the anonymous pack emboldens inaction. But to believe we are not contributing to the Empire because of our status as an individual snowflake flatly denies our involvement in the avalanche.

Empire does not require willing participation, just involvement plain and simple. The more our contribution is reduced, the less dependent we become, the less contributory we are.

The ugly, and self evident, truth is the vast majority of us wish to partake of the spoils of Empire while denying Empire and the means by which it acquires the spoils. We know any significant change to our living arrangement involves dislocation, deprivation and uncertainty.

We pontificate about high moral aspirations while decrying the despicable greed and self interest of the elite and powerful. Yet our perceived ‘enlightened’ self interest dictates our own (in) action even if it ultimately undermines us as well as our family and friends.

Who are we kidding if not our ‘self’?

As stated previously, Mrs. Cog and I do not have the answers, let alone a firm understanding of all the questions. What we believe we know is extremely personal in nature, but can be universally applied.

Either we declare powerless victimhood by doing little to nothing while awaiting the ‘sign’ to engage Plan B, or we execute a living breathing plan of action here and now by changing nearly everything about our lives and begin the process of reclaiming our personal sovereignty one step at a time.

To change the world I must first change myself. To approach this in any other manner is to adopt the techniques and mindset we decry as dishonest, disingenuous and corrupt. I have come to realize the approaching trials are about so much more than just survival.

This is about personal growth and spiritual transformation, of reaching for and achieving a higher plain of existence greater than the lowest common denominator, the heart of the fraud the Empire promotes and which “We the People” are addicted to and dependent upon.

And this, I suspect, is what truly holds so many people back.

For to break from the herd and look squarely in the mirror requires a fearless self examination and assessment, precisely what we are conditioned to avoid at all costs in our mindless pursuit of self absorbed consumerism.

The promoted myth is simple enough; when we exit the education indoctrination system the only remaining items left to pursue are specific skills required to further our ‘career’, which in turn provides the money to pay the debts that support the self destructive consumer lifestyle.

Turning our back on this meme and consciously choosing a life of more focused labor and dedication to self sufficiency and independence is not aligned with the bargain we struck with the system back when we entered grade school all those years ago. I made a deal with the devil in return for a life of leisure when I hit age 65.

To question this fundamental ‘truth’ requires us to question everything, something very few of us are willing to do.

Are you?
Either you position yourself before the skies darken or you are left groping in the dark.

Top Dems condemn Snowden

SUBHEAD: Via satellite at Bard College Snowden disputed Clinton’s claim that he bypassed whistleblower protections.

By Tom McCartney on 16 October 2015 for the Guardian -
(http://www.theguardian.com/us-news/2015/oct/16/edward-snowden-hillary-clinton-false-claim-whistleblower-protection)

Image above: Edward Snowden speaks, via video-conference, at Bard College in New York on Friday. Photo by Beka Geodde. From original article.

Edward Snowden has accused Hillary Clinton of “a lack of political courage” for her assertion during the Democratic presidential debate this week that the whistleblower had bypassed options for disclosing illegal government spying programs that would have protected him and not violated the law.

Speaking via satellite at a privacy conference at New York’s Bard College on Friday, Snowden said:
“Hillary Clinton’s claims are false here.”
“This is important, right?” Snowden told an audience at the Hannah Arendt Center at Bard College. “Truth should matter in politics, and courage should matter in politics, because we need change. Everyone knows we need change. And we have been aggrieved and in many ways misled by political leaders in the past.”

Before Snowden spoke, Clinton repeated the claim on Friday, at a campaign appearance in New Hampshire. After a voter said Snowden was “close to a patriot,” BuzzFeed reported, Clinton disagreed and said he could have received whistleblower protections but instead chose to break the law.

“He broke the laws of the United States,” Clinton said at the debate on Tuesday. “He could have been a whistleblower. He could have gotten all of the protections of being a whistleblower. He could have raised all the issues that he has raised.

And I think there would have been a positive response to that.”

Multiple passes at fact-checking Clinton’s claim this week have concluded that “the protections of being a whistleblower” do not exist in the real world and did not apply to Snowden.

A 1989 whistleblower law, for example, does not apply to intelligence community employees. A separate law for would-be intelligence whistleblowers has been deemed a trap because it has led not to protections but to prosecutions.

“There is, I think, in many ways a lack of political courage in the established class that we expect to champion [our rights],” Snowden said at Bard, to enthusiastic applause.
The second US Circuit Court of Appeals in Manhattan ruled in May that the dragnet phone metadata collection program exposed by Snowden was indeed illegal.

In a wide-ranging question-and-answer session that lasted the better part of two hours, Snowden also rejected the premise of a question at the debate as to whether he was a hero or traitor. He discussed his Twitter habits, criticized Facebook for taking the side of the government over the side of users, and he praised the unidentified whistleblower who provided documents relating to drone warfare published on Thursday in an exposé by The Intercept.

“Thanks to some extraordinary whistleblower who provided this information to the Intercept, we now know that these drone attacks that claimed the lives of innocents, 90% of the time, nine out of 10 of those killed are not the intended targets,” Snowden said.

He dismissed the hero-or-traitor question, which CNN host Anderson Cooper posed at the presidential debate.

“I reject both [labels],” Snowden said. “Because even though people say being a hero would be a good thing, it’s other-izing, it’s distancing, it’s, ‘This person did something I could never do in that situation’ – that’s absolutely not true.”

Asked about being a privacy advocate who has nonetheless become active on Twitter, Snowden said he uses Tor and other “privacy-enhancing technologies” to protect his personal information when he uses social media.

He did not appear to be a Facebook user. “They’re really unwilling to make a commitment to the user,” Snowden said of the site. “They really need to decide who they work for – the government, or the people who use their services.”

Asked whether he was willing to face charges for leaking classified material, Snowden said that the law under which he has been charged, the Espionage Act of 1917, would not allow him to make the case that he had acted in the public good.

Snowden said he had been in contact with the government – apparently not recently – about how some kind of plea deal would work.

“They said ‘Well, we won’t torture you’,” Snowden said. “‘But we haven’t got beyond that.’”

Sanders & Clinton condemn Snowden
SUBHEAD: Both Democratic presidential candidates say Snowden should face criminal prosecution for revealing NSA secrets.

By Sam Thielman on 13 October 2015 for the Guardian -
(http://www.theguardian.com/us-news/2015/oct/13/clinton-sanders-snowden-nsa-democratic-debate)

Hillary Clinton and Bernie Sanders sparred over Edward Snowden during Tuesday’s Democratic presidential debate with both calling for him to face trial, but with the Vermont senator saying he thought the NSA whistleblower had “played a very important role in educating the American people”.

Clinton was unmoved by public approbation for Snowden, who exposed the depths of US and UK surveillance to media including the Guardian in 2013.

“He broke the laws of the United States,” she said. “He could have been a whistleblower, he could have gotten all the protections of a whistleblower. He chose not to do that. He stole very important information that has fallen into the wrong hands so I think he should not be brought home without facing the music.”

Snowden has said he did not believe he was granted adequate protection from reprisal under whistleblower laws. Laws protecting whistleblowers in intelligence agencies are written differently from laws protecting others who oppose their employers – including in the government – on grounds of conscience, and are generally considered comparatively weak.

Sanders – Clinton’s main challenger for the Democratic nomination – was more lenient. “I think Snowden played a very important role in educating the American public,” the Vermont senator said. He, too, said that Snowden had broken the law and suggested that he ought to be tried. “I think there should be a penalty to that,” he said. “But I think that education should be taken into consideration before the sentencing.”

Jim Webb, the Virginia senator and former secretary of the navy, said the decision should be left to the courts, and Martin O’Malley, the former Maryland governor, agreed with Clinton. Lincoln Chafee, the former Rhode Island governor, was the only candidate to say he would bring Snowden back to the US as a hero; that answer drew a positive response online.

Clinton’s claim that the information Snowden made public “has fallen into the wrong hands” could be reference to a disputed Times of London story that the leak exposed undercover agents. It could also refer to Snowden’s own admission that inadequate redaction of classified images he supplied to the New York Times was “a fuck-up”.

Ewen MacAskill, the Pulitzer prize-winning Guardian journalist who worked on the Snowden story, has pointed out that no evidence has ever been put forward suggesting that the Snowden documents were hacked or that Snowden himself handed the material to any person or agency other than reputable news outlets.

When moderator Anderson Cooper asked Clinton whether she regretted voting for the Patriot Act, she gave a flat: “No.”

“I don’t,” she said. “I think that it was necessary to make sure that we were able after 9/11 to put in place the security that we needed.” Clinton did allow that the act’s notorious section 215, which allowed for essentially unlimited data collection, had been interpreted overbroadly.

The provisions of the Patriot Act, a law broadening the powers of American intelligence and law enforcement agencies passed just weeks after 9/11, have widely been criticized as too broad and being without accountability.

Among them are the expansion of the secret Fisa court system and a framework for the standards for the collection of personal information from citizens who are not suspected or accused of any crime.

Sanders – who voted against the act multiple times, including against its original incarnation in the House of Representatives – said unequivocally that he would end bulk data collection by the NSA.
Clinton demurred. “It’s not easy to balance privacy and security but we have to keep them both in mind,” she said.

Deep Green Resistance frightens US

SUBHEAD: Members of Deep Green Resistance denied entry to Canada on the way to a Chris Hedges’ lecture.

By Adam Federman on 30 September 2015 for Earth Island Journal -
(http://www.earthisland.org/journal/index.php/elist/eListRead/environmental_activists_continue_to_face_interrogations_at_us-canada_border/)

Image above: The Peace Arch border crossing between British Columbia, Canada and Washington, USA. From original article.

Three members of the radical environmental organization Deep Green Resistance and two other individuals were detained for more than seven hours at the Peace Arch border crossing between Washington State and British Columbia on their way to Vancouver to attend a talk by author and activist Chris Hedges last Friday, September 25.

They were questioned about the organizations they were involved in, their political affiliations, and their contacts in Canada before being turned away by Canadian border agents. Upon re-entering the United States they were then subjected to another round of questioning by US border agents. The car they were traveling in as well as their personal computers were searched.

The interrogation comes on the heels of an FBI inquiry into Deep Green Resistance last fall in which more than a dozen members of the group were contacted and questioned by FBI agents.

Several months later the group’s lawyer, Larry Hildes, was stopped at the same border crossing and asked specifically about one of his clients, Deanna Meyer, also a Deep Green Resistance member.

During the 2014 visits, FBI and Department of Homeland Security agents showed up at members’ places of work, their homes, and contacted family members to find out more about the group.

Meyer, who lives in Colorado, was asked by a DHS agent if she’d be interested in “forming a liaison.” The agent told her he wanted to, “head off any injuries or killing of people that could happen by people you know.” Two of the members detained at the border on Friday were also contacted by the FBI last fall.

Since Hildes was last held up at the Peace Arch border crossing in June he filed a complaint with the Department of Homeland Security’s Traveler Redress Inquiry Program.

In August he received a letter from the DHS saying the agency “can neither confirm nor deny any information about you which may be within federal watchlists or reveal any law enforcement sensitive information.”

It’s not only Deep Green Resistance members who have had trouble getting across the border.

Environmental activists who were part of a campaign in Texas opposing  the Keystone XL pipeline were the targets of an FBI investigation in 2012 and 2013 and have also been denied entry into Canada. At least one of those activists, Bradley Stroot, has been placed on a selective screening watchlist for domestic flights.

Nearly all of the activists involved are US citizens who have not had issues traveling to Canada in the past, leading them to believe that the recent FBI investigation and interest in their activities has landed them on some kind of federal watchlist.

According to Peter Edelman, an immigration attorney in Vancouver, there are three broad categories under which Canadian border agents may deny entry to a foreign national:
  • If they suspect you are entering Canada to work or study or you clearly don’t have the financial resources needed for the duration of the visit;
  • If you pose a security threat to Canada or are a member of a terrorist or criminal organization; or
  • If you’ve committed certain crimes.
Edelman says that US citizens tend to get targeted more easily at the Canadian border because of the various information sharing programs between the two countries. As soon as they scan your passport, border agents have access to a whole host of state and federal databases. Still, Edelman says, “Who gets targeted and who doesn’t is definitely an exercise in profiling.”

On Friday, September 25 Deep Green Resistance members Max Wilbert, Dillon Thomson, Rachel Ivey and two other individuals not affiliated with the group drove from Eugene, Oregon to attend the talk by Hedges, which was a collaboration with the Vancouver Rape Relief and Women’s Shelter and the Asian Women Coalition Ending Prostitution.

They got to the border around 1 p.m., told the border agents where they were going, and that they’d be returning to Oregon the next day. They were then asked to exit their vehicle and enter the border control facility, where they assumed they would be held briefly before continuing on their way.

Instead, they ended up spending four hours on the Canadian side, each questioned separately. At one point, an agent came into the building carrying Wilbert’s computer and notebooks. He asked the agent what they were doing with the computer and was told they were searching for “child pornography and evidence that you’re intending to work in Canada.” The agent also said they were “not going to add or remove anything.”

According to Edelman the searching of computers and cell phones at the border has become standard procedure despite the fact that there are questions about whether a border search allows for such invasive measures. Border agents take the view that they are permitted to do so, but the legal picture remains murky. “The searching of computers is an issue of contention,” Edelman says.

After four hours of questioning, all but one of the travelers were told that they would not be allowed to enter Canada. Wilbert, who grew up in Seattle and has traveled to Canada many times without incident, including as recently as January 2015, was told that they were suspicious he was entering the country to work illegally.

A professional photographer, he had volunteered to take pictures of the event, which he had openly told the agents. “It was pretty obvious they were grasping for straws,” Wilbert says. “Under that level of suspicion you wouldn’t let anybody into Canada.”

The other three individuals were told they had been denied entry for previous political protest-related arrests. Rachel Ivey, a Deep Green Resistance member arrested in 2012 during a protest near the Pine Ridge Oglala Sioux Reservation in South Dakota, had traveled to Canada in December 2014 without any problems.

The one individual allowed entry had no prior arrest record or explicit affiliation with any political groups. (Interestingly, several Deep Green Resistance members traveling separately, including one of the group’s founders, Lierre Keith, were allowed to pass through the border and attend the event.)

After being denied entry to Canada, the group turned around and attempted to reenter the United States, at which point they were again pulled aside and told by US border agents to exit their car.

The group was then subjected to a similar round of questioning that lasted three and a half hours. This time, US agents took three computers from the vehicle into the border control facility and kept them for the duration of the interrogation.

According to Wilbert, the questions on the American side were more obviously political. Agents wanted to know the names of the groups they were involved in, what kinds of activities they engage in, what they believe in, and who they were going to see.

“It seemed very clear on the US side that they had already come to conclusions about who we are and what we were doing,” Ivey says.

Around 8:30 p.m. they were told they could leave and that it had been nothing more than a routine inspection.

Wilbert doesn’t see it that way. Two days later he got a new computer and says he plans to get rid of the one seized by border agents. Despite assurances from the border officials that nothing was “added or removed” he says, “We feel like everything we do on those computers will never be private.”

“It was pretty clear to us that it was an information gathering excursion,” says Wilbert. “They had an opportunity to harass and intimidate and gather information from activists who they find threatening.”

ISIS made in USA

SUBHEAD: Secret Pentagon Report Reveals US "Created" ISIS As A "Tool" To Overthrow Syria's President Assad.

By Nafeez Ahmed on 24 May 2015 for Zero Hedge -
(http://www.zerohedge.com/news/2015-05-23/secret-pentagon-report-reveals-us-created-isis-tool-overthrow-syrias-president-assad)

Image above: The unknown man was photographed being killed by a masked executioner in a village just outside ISIS' stronghold and de facto capital Raqqa while a large crowd looked on in February 2015. From (http://www.dailymail.co.uk/news/article-2945684/Beheaded-WITCHCRAFT-Latest-ISIS-execution-Syria-echoes-Dark-Ages-man-killed-invoking-magic.html).

From the first sudden, and quite dramatic, appearance of the fanatical Islamic group known as ISIS which was largely unheard of until a year ago, on the world's stage and which promptly replaced the worn out and tired al Qaeda as the world's terrorist bogeyman, we suggested that the "straight to beheading YouTube clip" purpose behind the Saudi Arabia-funded Islamic State was a simple one:
Use the Jihadists as the vehicle of choice to achieve a political goal: depose of Syria's president Assad, who for years has stood in the way of a critical Qatari natural gas pipeline, one which could dethrone Russia as Europe's dominant - and belligerent - source of energy, reaching an interim climax with the unsuccessful Mediterranean Sea military build up of 2013, which nearly resulted in quasi-world war.

The narrative and the plotline were so transparent, even Russia saw right through them. Recall from September of last year:
If the West bombs Islamic State militants in Syria without consulting Damascus, LiveLeak reports that the anti-ISIS alliance may use the occasion to launch airstrikes against President Bashar Assad’s forces, according to Russian Foreign Minister Sergey Lavrov. Clearly comprehending that Obama's new strategy against ISIS in Syria is all about pushing the Qatar pipeline through (as was the impetus behind the 2013 intervention push), Russia is pushing back noting that the it is using ISIS as a pretext for bombing Syrian government forces and warning that "such a development would lead to a huge escalation of conflict in the Middle East and North Africa."
But it's one thing to speculate; it's something entirely different to have hard proof.

And while speculation was rife that just like the CIA-funded al Qaeda had been used as a facade by the US to achieve its own geopolitical and national interests over the past two decades, so ISIS was nothing more than al Qaeda 2.0, there was no actual evidence of just this.

That may all have changed now when a declassified secret US government document obtained by the public interest law firm, Judicial Watch, shows that Western governments deliberately allied with al-Qaeda and other Islamist extremist groups to topple Syrian dictator Bashir al-Assad.

According to investigative reporter Nafeez Ahmed in Medium, the "leaked document reveals that in coordination with the Gulf states and Turkey, the West intentionally sponsored violent Islamist groups to destabilize Assad, despite anticipating that doing so could lead to the emergence of an ‘Islamic State’ in Iraq and Syria (ISIS).
According to the newly declassified US document, the Pentagon foresaw the likely rise of the ‘Islamic State’ as a direct consequence of the strategy, but described this outcome as a strategic opportunity to “isolate the Syrian regime.”
And not just that: as we reported last week, now that ISIS is running around the middle east, cutting people's heads of in 1080p quality and Hollywood-quality (perhaps literally) video, the US has a credible justification to sell billions worth of modern, sophisticated weapons in the region in order to "modernize" and "replenish" the weapons of such US allies as Saudi Arabia, Israel and Iraq.

But that the US military-industrial complex is a winner every time war breaks out anywhere in the world (usually with the assistance of the CIA) is clear to everyone by now. What wasn't clear is just how the US predetermined the current course of events in the middle east.

Now, thanks to the following declassified report, we have a far better understanding of not only how current events in the middle east came to be, but what America's puppermaster role leading up to it all, was.
From Nafeez Ahmed: Secret Pentagon report reveals West saw ISIS as strategic asset Anti-ISIS coalition knowingly sponsored violent extremists to ‘isolate’ Assad, rollback ‘Shia expansion', originally posted in Medium.

Hypocrisy
The revelations contradict the official line of Western government on their policies in Syria, and raise disturbing questions about secret Western support for violent extremists abroad, while using the burgeoning threat of terror to justify excessive mass surveillance and crackdowns on civil liberties at home.

Among the batch of documents obtained by Judicial Watch through a federal lawsuit, released earlier this week, is a US Defense Intelligence Agency (DIA) document then classified as “secret,” dated 12th August 2012.

The DIA provides military intelligence in support of planners, policymakers and operations for the US Department of Defense and intelligence community.
So far, media reporting has focused on the evidence that the Obama administration knew of arms supplies from a Libyan terrorist stronghold to rebels in Syria.

Some outlets have reported the US intelligence community’s internal prediction of the rise of ISIS. Yet none have accurately acknowledged the disturbing details exposing how the West knowingly fostered a sectarian, al-Qaeda-driven rebellion in Syria.

Charles Shoebridge, a former British Army and Metropolitan Police counter-terrorism intelligence officer, said:
“Given the political leanings of the organisation that obtained these documents, it’s unsurprising that the main emphasis given to them thus far has been an attempt to embarrass Hilary Clinton regarding what was known about the attack on the US consulate in Benghazi in 2012. However, the documents also contain far less publicized revelations that raise vitally important questions of the West’s governments and media in their support of Syria’s rebellion.”
The West’s Islamists
The newly declassified DIA document from 2012 confirms that the main component of the anti-Assad rebel forces by this time comprised Islamist insurgents affiliated to groups that would lead to the emergence of ISIS. Despite this, these groups were to continue receiving support from Western militaries and their regional allies.

Noting that “the Salafist [sic], the Muslim Brotherhood, and AQI [al-Qaeda in Iraq] are the major forces driving the insurgency in Syria,” the document states that “the West, Gulf countries, and Turkey support the opposition,” while Russia, China and Iran “support the [Assad] regime.”

The 7-page DIA document states that al-Qaeda in Iraq (AQI), the precursor to the ‘Islamic State in Iraq,’ (ISI) which became the ‘Islamic State in Iraq and Syria,’ “supported the Syrian opposition from the beginning, both ideologically and through the media.”

The formerly secret Pentagon report notes that the “rise of the insurgency in Syria” has increasingly taken a “sectarian direction,” attracting diverse support from Sunni “religious and tribal powers” across the region.

In a section titled ‘The Future Assumptions of the Crisis,’ the DIA report predicts that while Assad’s regime will survive, retaining control over Syrian territory, the crisis will continue to escalate “into proxy war.”

The document also recommends the creation of “safe havens under international sheltering, similar to what transpired in Libya when Benghazi was chosen as the command centre for the temporary government.”

In Libya, anti-Gaddafi rebels, most of whom were al-Qaeda affiliated militias, were protected by NATO ‘safe havens’ (aka ‘no fly zones’).

‘Supporting powers want’ ISIS entity

In a strikingly prescient prediction, the Pentagon document explicitly forecasts the probable declaration of “an Islamic State through its union with other terrorist organizations in Iraq and Syria.”

Nevertheless, “Western countries, the Gulf states and Turkey are supporting these efforts” by Syrian “opposition forces” fighting to “control the eastern areas (Hasaka and Der Zor), adjacent to Western Iraqi provinces (Mosul and Anbar)”:
“… there is the possibility of establishing a declared or undeclared Salafist Principality in eastern Syria (Hasaka and Der Zor), and this is exactly what the supporting powers to the opposition want, in order to isolate the Syrian regime, which is considered the strategic depth of the Shia expansion (Iraq and Iran).”
The secret Pentagon document thus provides extraordinary confirmation that the US-led coalition currently fighting ISIS, had three years ago welcomed the emergence of an extremist “Salafist Principality” in the region as a way to undermine Assad, and block off the strategic expansion of Iran. Crucially, Iraq is labeled as an integral part of this “Shia expansion.”

The establishment of such a “Salafist Principality” in eastern Syria, the DIA document asserts, is “exactly” what the “supporting powers to the [Syrian] opposition want.” Earlier on, the document repeatedly describes those “supporting powers” as “the West, Gulf countries, and Turkey.”

Further on, the document reveals that Pentagon analysts were acutely aware of the dire risks of this strategy, yet ploughed ahead anyway.

The establishment of such a “Salafist Principality” in eastern Syria, it says, would create “the ideal atmosphere for AQI to return to its old pockets in Mosul and Ramadi.” Last summer, ISIS conquered Mosul in Iraq, and just this month has also taken control of Ramadi.
Such a quasi-state entity will provide:
“… a renewed momentum under the presumption of unifying the jihad among Sunni Iraq and Syria, and the rest of the Sunnis in the Arab world against what it considers one enemy. ISI could also declare an Islamic State through its union with other terrorist organizations in Iraq and Syria, which will create grave danger in regards to unifying Iraq and the protection of territory.”
The 2012 DIA document is an Intelligence Information Report (IIR), not a “finally evaluated intelligence” assessment, but its contents are vetted before distribution. The report was circulated throughout the US intelligence community, including to the State Department, Central Command, the Department of Homeland Security, the CIA, FBI, among other agencies.

In response to my questions about the strategy, the British government simply denied the Pentagon report’s startling revelations of deliberate Western sponsorship of violent extremists in Syria. A British Foreign Office spokesperson said:
“AQ and ISIL are proscribed terrorist organisations. The UK opposes all forms of terrorism. AQ, ISIL, and their affiliates pose a direct threat to the UK’s national security. We are part of a military and political coalition to defeat ISIL in Iraq and Syria, and are working with international partners to counter the threat from AQ and other terrorist groups in that region. In Syria we have always supported those moderate opposition groups who oppose the tyranny of Assad and the brutality of the extremists.”
The DIA did not respond to request for comment.

Strategic asset for regime-change
Security analyst Shoebridge, however, who has tracked Western support for Islamist terrorists in Syria since the beginning of the war, pointed out that the secret Pentagon intelligence report exposes fatal contradictions at the heart of official pronunciations:
“Throughout the early years of the Syria crisis, the US and UK governments, and almost universally the West’s mainstream media, promoted Syria’s rebels as moderate, liberal, secular, democratic, and therefore deserving of the West’s support. Given that these documents wholly undermine this assessment, it’s significant that the West’s media has now, despite their immense significance, almost entirely ignored them.”
According to Brad Hoff, a former US Marine who served during the early years of the Iraq War and as a 9/11 first responder at the Marine Corps Headquarters in Battalion Quantico from 2000 to 2004, the just released Pentagon report for the first time provides stunning affirmation that:
“US intelligence predicted the rise of the Islamic State in Iraq and the Levant (ISIL or ISIS), but instead of clearly delineating the group as an enemy, the report envisions the terror group as a US strategic asset.”
Hoff, who is managing editor of Levant Report — ?an online publication run by Texas-based educators who have direct experience of the Middle East?—?points out that the DIA document “matter-of-factly” states that the rise of such an extremist Salafist political entity in the region offers a “tool for regime change in Syria.”
The DIA intelligence report shows, he said, that the rise of ISIS only became possible in the context of the Syrian insurgency?—?“there is no mention of US troop withdrawal from Iraq as a catalyst for Islamic State’s rise, which is the contention of innumerable politicians and pundits.” The report demonstrates that:
“The establishment of a ‘Salafist Principality’ in Eastern Syria is ‘exactly’ what the external powers supporting the opposition want (identified as ‘the West, Gulf Countries, and Turkey’) in order to weaken the Assad government.”
The rise of a Salafist quasi-state entity that might expand into Iraq, and fracture that country, was therefore clearly foreseen by US intelligence as likely?—?but nevertheless strategically useful?—?blowback from the West’s commitment to “isolating Syria.”

Complicity
Critics of the US-led strategy in the region have repeatedly raised questions about the role of coalition allies in intentionally providing extensive support to Islamist terrorist groups in the drive to destabilize the Assad regime in Syria.

The conventional wisdom is that the US government did not retain sufficient oversight on the funding to anti-Assad rebel groups, which was supposed to be monitored and vetted to ensure that only ‘moderate’ groups were supported.

However, the newly declassified Pentagon report proves unambiguously that years before ISIS launched its concerted offensive against Iraq, the US intelligence community was fully aware that Islamist militants constituted the core of Syria’s sectarian insurgency.

Despite that, the Pentagon continued to support the Islamist insurgency, even while anticipating the probability that doing so would establish an extremist Salafi stronghold in Syria and Iraq.

As Shoebridge told me, “The documents show that not only did the US government at the latest by August 2012 know the true extremist nature and likely outcome of Syria’s rebellion”?—?namely, the emergence of ISIS?—?“but that this was considered an advantage for US foreign policy. This also suggests a decision to spend years in an effort to deliberately mislead the West’s public, via a compliant media, into believing that Syria’s rebellion was overwhelmingly ‘moderate.’”

Annie Machon, a former MI5 intelligence officer who blew the whistle in the 1990s on MI6 funding of al-Qaeda to assassinate Libya’s former leader Colonel Gaddafi, similarly said of the revelations:
“This is no surprise to me. Within individual countries there are always multiple intelligence agencies with competing agendas.”
She explained that MI6’s Libya operation in 1996, which resulted in the deaths of innocent people, “happened at precisely the time when MI5 was setting up a new section to investigate al-Qaeda.”
This strategy was repeated on a grand scale in the 2011 NATO intervention in Libya, said Machon, where the CIA and MI6 were:
“… supporting the very same Libyan groups, resulting in a failed state, mass murder, displacement and anarchy. So the idea that elements of the American military-security complex have enabled the development of ISIS after their failed attempt to get NATO to once again ‘intervene’ is part of an established pattern. And they remain indifferent to the sheer scale of human suffering that is unleashed as a result of such game-playing.”

Divide and rule
Several US government officials have conceded that their closest allies in the anti-ISIS coalition were funding violent extremist Islamist groups that became integral to ISIS.

US Vice President Joe Biden, for instance, admitted last year that Saudi Arabia, the UAE, Qatar and Turkey had funneled hundreds of millions of dollars to Islamist rebels in Syria that metamorphosed into ISIS.

But he did not admit what this internal Pentagon document demonstrates?—?that the entire covert strategy was sanctioned and supervised by the US, Britain, France, Israel and other Western powers.

The strategy appears to fit a policy scenario identified by a recent US Army-commissioned RAND Corp report.

The report, published four years before the DIA document, called for the US “to capitalise on the Shia-Sunni conflict by taking the side of the conservative Sunni regimes in a decisive fashion and working with them against all Shiite empowerment movements in the Muslim world.”

The US would need to contain “Iranian power and influence” in the Gulf by “shoring up the traditional Sunni regimes in Saudi Arabia, Egypt, and Pakistan.” Simultaneously, the US must maintain “a strong strategic relationship with the Iraqi Shiite government” despite its Iran alliance.

The RAND report confirmed that the “divide and rule” strategy was already being deployed “to create divisions in the jihadist camp. Today in Iraq such a strategy is being used at the tactical level.”

The report observed that the US was forming “temporary alliances” with al-Qaeda affiliated “nationalist insurgent groups” that have fought the US for four years in the form of “weapons and cash.” Although these nationalists “have cooperated with al-Qaeda against US forces,” they are now being supported to exploit “the common threat that al-Qaeda now poses to both parties.”

The 2012 DIA document, however, further shows that while sponsoring purportedly former al-Qaeda insurgents in Iraq to counter al-Qaeda, Western governments were simultaneously arming al-Qaeda insurgents in Syria.

The revelation from an internal US intelligence document that the very US-led coalition supposedly fighting ‘Islamic State’ today, knowingly created ISIS in the first place, raises troubling questions about recent government efforts to justify the expansion of state anti-terror powers.

In the wake of the rise of ISIS, intrusive new measures to combat extremism including mass surveillance, the Orwellian ‘prevent duty’ and even plans to enable government censorship of broadcasters, are being pursued on both sides of the Atlantic, much of which disproportionately targets activists, journalists and ethnic minorities, especially Muslims.

Yet the new Pentagon report reveals that, contrary to Western government claims, the primary cause of the threat comes from their own deeply misguided policies of secretly sponsoring Islamist terrorism for dubious geopolitical purposes.

Jade Helm - US Martial Law

SUBHEAD: Marines practice subduing "unruly citizens" inside mock internment camps while role players chant for food and water.

By Paul Joseph Watson on 15 May 2015 for SHTF Plan -
(http://www.shtfplan.com/headline-news/video-marines-practice-subduing-citizens-inside-internment-camps_05152015)

Image above: US Marines practice subduing "unruly" American citizens in Yuma, Arizona, on April 17th Jade Helm exercise.  From original article.

Alarming video footage from a U.S. Marines training drill which took place in Arizona last month shows armed troops chasing down unruly citizens inside a mock internment camp while role players chant for food and water.

The exercise, which involved U.S. Marines from 1st Battalion, 5th Marine Regiment, 1st Marine Division, took place on April 18 in Yuma, Arizona and revolved around “assault support tactics” training.

The drill was part of, “standardized tactical training and certification of unit instructor qualifications to support Marine Aviation Training and Readiness,” according to the description accompanying the video.

In plain English, the exercise was about subduing, arresting and incarcerating irate citizens during a martial law-style scenario.

Video above: U.S. Marines from 1st Battalion, 5th Marine Regiment, 1st Marine Division participate in assault support tactics 3 during Weapons and Tactics Instructor Course (WTI) 2-15 in Yuma, Ariz., April 17, 2015. From (https://youtu.be/uTIKKxRi4ww).

The video shows Marines landing in helicopters on a field next to a busy highway. Locals watch the exercise behind a perimeter fence while role players prepare to take part in the drill.

The Marines then practice apprehending unruly citizens, one of whom is carried away on a stretcher.

One of the role players simulates attempting to escape the enclosure before he is chased down and handcuffed by an armed Marine.

Other role players are then heard chanting “Food" and "Water” while rattling the perimeter fence as Marines look on. The video then shows more role players being chased and hauled away. One of the role players is subsequently heard to shout, “Let me out!”

Image above: US Marine attends to role playing "injured" American citizens in Yuma, Arizona, on April 17th Jade Helm exercise.  From original article.

More physical struggles and chases ensue between role players and Marines before some of the citizens receive mock medical treatment, with one Marine heard describing one of the injuries as “gunshot wounds to the chest.”

Some of the victims are then loaded onto the chopper before the video clip ends.

The Marines will undoubtedly claim that these exercises are to prepare for overseas combat and occupation missions, but U.S. Army manuals have made it clear that such operations also apply to the Continental United States (CONUS), and will be used against American citizens during a national emergency.

Concerns over such exercises have been raised after the announcement of Jade Helm, a nationwide military exercise set to begin in July during which troops will operate undercover amongst local populations.

Innumerable videos showing similar drills taking place across the United States have emerged in recent months, although this footage is easily the most alarming.

Another video out of Fort Lauderdale, Florida which emerged in March also showed military and law enforcement practicing the internment of citizens during martial-law style training.

Secret law is not law

SUBHEAD: The secrecy of the legal justifications for NSA surveillance violates international human rights law.

By Cindy Cohn on 15 September 2014 for Electronic Frontier Foundation -
(https://www.eff.org/deeplinks/2014/09/secret-law-not-law)

Image above: An appropriate great seal for the NSA's spying operation. From (http://www.dantynan.com/2013/06/11/love-trees-hate-meat-you-too-may-be-a-terrorist/).

One of the many ways that the NSA’s mass surveillance violates the human rights of both Americans and others around the world is that it teeters on a huge pile of secret law.

Let’s be clear. Under international human rights law, secret “law” doesn’t even qualify as “law” at all.

The Human Rights Committee confirms that law is only law if people know it exists and can act based on that knowledge. Article 19 of the ICCPR, protecting the freedoms of opinion and expression, requires that “to be characterized as a “law,” [a law] must be formulated with sufficient precision to enable an individual to regulate his or her conduct accordingly and it must be made accessible to the public. . . . “1 This same conclusion applies to Article 17, the right to privacy. The European Court of Human Rights similarly notes in the context of surveillance:
[T]he law must be sufficiently clear in its terms to give citizens an adequate indication as to the circumstances in which and the conditions on which public authorities are empowered to resort to this secret and potentially dangerous interference with the right to respect for private life and correspondence.2
This includes not just the law itself, but the judicial and executive interpretations of written laws because both of those are necessary to ensure that people have clear notice of what will trigger surveillance.

This is a basic and old legal requirement: it can be found in all of the founding human rights documents. It allows people the fundamental fairness of understanding when they can expect privacy from the government and when they cannot.

It avoids the Kafkaesque situations in which people, like Joseph K in The Trial and the thousands of people on the secret No Fly Lists, cannot figure out what they did that resulted in government scrutiny, much less clear their names.

And it ensures that government officials have actual limits to their discretion and that when those limits are crossed, redress is possible.

Just how far has the US strayed from this basic principle in its mass surveillance practices? Very far. The existence of the mass surveillance was kept officially secret from the world for over a decade, from when it started in earnest in 2001 until June of 2013 after the Snowden revelations. The surveillance at first had no judicial authorization whatsoever.

Various pieces of it were brought under judicial authority --  email records in 2004, U.S. domestic telephone records in 2006 and backbone and other content collection in 2007 -- but these court decisions also happened entirely in secret, so the public still didn't know. Even today, large amounts of both the caselaw and the Executive Branch’s internal legal guidance have been kept from the public.

To the extent we know anything about what the government is doing, this has been based on the piecemeal (and often highly fragmented) release of information as the result of dogged FOIA work and the legal cases brought by EFF plus our friends at the ACLU and EPIC.3

The breadth of the secret law is astonishing. For instance, only after the Snowden revelations did the government first admit its legal theories -- that its mass spying relied on outrageous secret interpretations of section 215 of the PATRIOT ACT and section 702 of the FISA Amendments Act -- neither of which even mentions mass surveillance much less authorizes it. We also now know about the NSA’s domestic telephone records collection and a past program that collected cell location information but we still don’t know the NSA’s full use of section 215.

In fact, on September 2 the government sidestepped questions from the Second Circuit about whether its legal arguments in support of its telephone records collection could also support the mass collection of all credit card or bank records of Americans (hint: it could).

Nor are these secret, often extremely weak interpretations of otherwise public laws the only problem. Sometimes there’s no “law” at all. The NSA’s foreign collection processes, which are much more extensive than their domestic collections, are only ostensibly justified by an Executive Order, currently Executive Order12333. While E.O. 12333 is public, it’s not law at all and it certainly does not mention mass surveillance of millions of innocent people around the world.

None of the government’s legal interpretations of it are public either. We've now seen evidence that this non-law with secret interpretations is the basis for the NSA's mass surveillance of communications not just in one place, but at nearly every step of their journey: from remote access to computers, to man-in-the-middle attacks on messages in transit, to attacking direct service providers like Google, to tapping into the undersea cables. Yet the legal basis for these unprecedented intrusions into privacy remains opaque.
To bring the U.S. in line with international law, it must stop the process of developing secret law and ensure that all Americans, and indeed all people who may be subject to its surveillance have clear notice of when surveillance might occur. Terrorists and other criminals already well understand that they can be subject to surveillance during an investigation, so the people who are hurt are the innocent.

Some operational details can and should remain secret, of course, but the law must be sufficiently clear to allow innocent people to understand when and how they may be subject to surveillance and, as they wish, take steps to regain their privacy. Only then will the U.S. fulfill its obligations under international law.

America's Drone War, the eighth full-length feature documentary from director Robert Greenwald and his Brave New Foundation organization, investigates the impact that U.S. drone strikes have across the globe.

The film reveals the realities of drone warfare-the violation of international law, the loss of life, the far-reaching implications for the communities that live under drones, and blowback the United States faces. Unmanned details the death of Tariq Aziz, a 16 year-old Pakistani boy, who like most teenagers, loved soccer and his computer.

He was killed in a drone strike three days after attending a public meeting in Islamabad calling for the end of drone strikes in Pakistan. Unmanned also investigates the Obama administration's use of signature strikes that targets people based on 'pattern of life' characteristics.

One such example took place in 2011 in Datta Khel, a tribal region in northern Pakistan, killing approximately 41 people and injuring scores more.

Robert Greenwald's newest full-length feature is now available.
