Standing Rock lawsuit update

On July 27, 2016, the Standing Rock Sioux filed a lawsuit against the Army Corps of Engineers for authorizing the construction of the 1,172-mile Dakota Access pipeline. Just over a year later, the project has been completed and carries crude oil from North Dakota’s Bakken oil fields to an export terminal in Illinois. The case is still pending, and continues to be the tribe’s last hope to protect its water and land.

The lawsuit alleged that authorization of the pipeline violated the Clean Water Act, Rivers and Harbors Act, and the National Environmental Policy Act by failing to adequately conduct an efficient environmental assessment and skipping an environmental impact statement (EIS) altogether.

“If history is to repeat itself, it doesn’t look good for us,” says Standing Rock Sioux Tribe Chairman Dave Archambault II. “But that doesn’t mean we don’t have hope.”

The lawsuit has now been joined by the Cheyenne River Sioux and the Yankton and Oglala Sioux tribes, but at its heart, the case remains the same since its initial filing, said lead attorney Jan Hasselman, who represents the Standing Rock Sioux on behalf of nonprofit environmental law firm Earthjustice.

He’s been arguing that the $3.8 billion energy project ignores treaty rights and needs further environmental review. The goal is that U.S. District Court Judge James E. Boasberg will rule in favor of an EIS and pause pipeline operations indefinitely, and, ultimately, stop them completely.

In December, pipeline opponents almost secured the EIS under former President Barack Obama when the Army Corps of Engineers announced it would prepare the statement and not permit the pipeline to cross beneath the Lake Oahe crossing on the Missouri River, an area of cultural, religious, and spiritual significance to the tribe.

It was a near victory. With the EIS secured, the court shelved the lawsuit, but there was more bubbling beneath the surface. Dakota Access launched a counter lawsuit once the Obama administration requested the EIS, and Donald Trump’s presidential inauguration loomed on the horizon. The lawyers, the tribe, and even the court knew the situation could change drastically.

“The court was pretty explicit that this could be undone,” Hasselman said. And it was.

Trump rescinded the EIS and issued the final easement across Lake Oahe in February. Immediately, the attorneys amended their initial complaint to include the final easement. Things moved along quickly from there, Hasselman explained. For the first time, the tribe had something concrete to contest, not something they were asking the courts to prevent.

“We were finally able to put those environmental review issues and treaty issues up front and center,” Hasselman said. Until then, the case was essentially in “pause mode.”

Then in June, Judge Boasberg found that the Corps had not sufficiently considered the pipeline’s environmental effects or environmental justice impacts when issuing its permit, and remanded the case back to the EIS process to reconsider its analysis. This is the first time Earthjustice is aware of such an environmental justice ruling.

Boasberg’s recent decision offers DAPL’s opponents hope, but a favorable outcome is anything but assured. A pipeline has never before been stopped with a lawsuit, Hasselman said. “The legal and regulatory infrastructure is badly broken.

You just don’t have the big overarching federal permits for a crude oil pipeline that you have in a lot of other contexts.” Unlike natural gas pipelines, the Federal Energy Regulatory Commission regulates a pipeline’s terms and conditions of transport, but not its actual construction and operation.

Earthjustice didn’t take up the case because it believed the court held the answer but, rather, because it recognized the political power such a case could build. To that end, it has surpassed expectations.

“What I had in mind was substantially more modest than what happened,” Hasselman said. He had hoped that 50 people would show up to court and they’d end up on the evening news. He wasn’t expecting the iconic fight for indigenous sovereignty that Standing Rock has become.

The Dakota Access pipeline is now a matter of global interest. More than 380 tribes around the world—from New Zealand’s Māori to the Ecuadorian Amazon’s Kichwa—came forward to stand with the water protectors. “That’s a very significant time in history: when the tribes come together collectively and unite and say, Enough is enough,” Archambault said.

The tribe’s effort became a movement with the support of spirit and prayer camps outside the reservation—including the Sacred Stone and Oceti Sakowin camps—and a 1,500-mile run to Washington, D.C., in which about 30 Native American youth delivered a petition with more than 140,000 signatures to the Army Corps headquarters demanding it halt the pipeline’s construction.

Although this attention hasn’t influenced the lawsuit, Hasselman said, it legitimized the movement. Once the world set its eyes on Standing Rock, it could no longer ignore that the historic violent treatment of indigenous people isn’t a thing of the past—it continues today.

Now? Hasselman thinks they have a shot. “We have an uphill struggle in persuading the court to shut down the pipeline while the remand process is underway, and we have an uphill struggle persuading the Army Corps to do a legitimate and appropriate analysis on remand, but we’re all working 24/7 to make that happen,” he said.

Judge Boasberg is set to decide in September whether to pause pipeline operations while the Corps continues its review, and court proceedings are ongoing as both parties make their arguments. Until then, the tribe will see its challengers in court.

From Standing Rock to Maui

In November, organic farmer Alika Atay, the grassroots leader of Hawaii’s ʻĀina Protector’s United effort was elected to the Maui County Council in a stunning upset (described in detail here).
Atay was the lead plaintiff in the SHAKA Movement’s federal lawsuit over the invalidation of Maui’s successful GMO Moratorium initiative in 2014.

This Maui Independent In Their Own Words features the barrel-chested, deep-voiced leader known to many Native Hawai’ians as “Uncle Alika.” His words are from interviews conducted during the past year by journalist Jonathan Greenberg.

Protect Our Water

I stand to protect our drinking water. We are very similar to our brothers and sisters in the Dakotas fighting to protect the Missouri River because Ola Ka Wai: Water is life.

Aina Protectors United is like-minded people who have been raised under the values of Aloha Aina (love of the land). Everything we do has a connection to the earth and our resources. Given our responsibility under Aloha Aina, we must stand up and protect.

I am speaking for the land, for the water, for the children. We all have a responsibility to stand up for future generations. The importance of native water rights and the ʻĀina Protectors movement is to allow those of us who are of the ʻĀina to understand that this is our indigenous right that we are born with.

We need to stand up and say enough of the oppression.

For me and the people, we are all kanakas. If they poison us, if they allow this to continue, they are creating cultural ethno genocide. They are slowly killing us, the kanaka–Hawaiians and my children and my future descendants. If we die or if we get sick and this place gets polluted, where else do we go? We don’t have anywhere else to go in the world to call our homeland.

This is our homeland. And as Kanaka Maoli, as indigenous people of this land, we cannot allow corporations such as Monsanto to be more important than the health and welfare of our people.

We are into into grassroots democracy. Grassroots democracy comes from the ground up, from the indigenous, spiritual, and cultural level. It says we will live the way we want to live.

My involvement with this movement began 40 years ago, when agrochemical companies sprayed DDT onto their plants, like the pineapple plantations. After soaking the plants, the DDT soaked the soil, and after soaking the soil, it went down and hit our water aquifer. It tainted our drinking water well until we could no longer drink fresh water from the well. Forty years later that well is still tainted. We cannot drink that water. It is still tainted.

Monsanto fields are only 40 feet above sea level. We ran into a Monsanto field and saw their spray board. It said they sprayed a 100-acre field four times a day, and the next day, five times a day, the very next day four times. With different chemicals.

You drench the fields, and then you get a big rain. The earth becomes a wet sponge and gets saturated, and all that chemical poison gets pushed down. The question is not if it’s going to hit our water table. The question is if they keep this up unchecked, when will it hit our water table to also make it unsafe for us to be drinking fresh water?

I believe this is about water and the pesticides that affect water. I am concerned with the drenching of our land with pesticides and the effect this has on our water. We live on an island and must protect our sacred water.

We have to look at the damage heavy chemical pesticides are doing to the soil and the aquifer. Not only what affects us now but more so the long-term future concerns. What kind of water will our future generations have to drink?

Look at what our experience has been for the last two years against the biotech pesticide companies. During the [GMO Moratorium Initiative] contest, there was big, big involvement of organized corporate money, spending close to $8 million.

Yet the people voted yes, and the people defeated them. The big lesson was the power of the people; what was victorious was organized people.

If You Are Not at the Table, You Are On the Menu

If you are not at the table, you are on the menu.
Whatever community you are, whatever country you are, you’ve got to open your eyes and be at the table.

We have that power. We the people can organize ourselves to stand up against them and say, “This is wrong.” Yes we call out Aloha ʻĀina; love the land. But it is not as simple as that. You cannot interpret it just by the words. You have to understand the values that are in there. How do you practice Aloha ʻĀina values? By protecting our natural resources, protecting our water.

Right now, with this [November Council election] victory, we are setting the cornerstone of the house that we want to live in. It is up to the rest of the village to be involved in the construction of the house.

I am looking forward to setting policy, regulations, and enforcement that will protect our natural resources. We need our entire village to be involved to solve these problems.

We live on an island, and our job is to protect this aquifer, our sacred water. There is a wave of momentum for change to protect our Maui way of living. Everyone sees the handwriting on the wall and is concerned with protecting the environment, which also protects our tourist economy.

Our Responsibility to Become Great Ancestors

Our ancestors, my ancestors, they lived here for 1,500 years. They lived here organically, naturally.

They didn’t live with chemical poisons. Then my ancestors handed it over to me: green pristine, clean, and sacred.

And in a very short period, westernization came in and almost killed us. Almost. Unless we come in and say, “Nuff already. This ain’t happening.”

We want to become great ancestors.

I don’t want to pass on and have my descendants say, “My tutu—he didn’t do a good job by giving us this place all polluted.”

We have a responsibility to our future. That’s why we do this.

Lessons from Standing Rock

Here are five lessons activists around the world can learn from the water protectors.

On February 22, 2017, water protectors at the Oceti Sakowin camp, the primary camp of Standing Rock, were evicted by the Army Corps of Engineers in a military style takeover. A peaceful resistance that began with a sacred fire lit on April 1, 2016, ended in a blaze as some of the protectors, in a final act of defiance, set some of the camp’s structures on fire.

The millions of people around the world who have stood in solidarity and empathy with Standing Rock now stand in disbelief and grief, but the forced closure of the encampment is simply the latest chapter in a violent, 500-year-old history of colonization against the First Nations. It is also the latest chapter in the battle between an extractive capitalist model and the possibility of a post-capitalist world.

Of course, the ongoing struggle will not go down in the flames at Oceti Sakowin. We should take this opportunity to remember the enduring lessons of this movement, and prepare ourselves for what is to come next.

1. There is a global convergence of movements
When I visited Standing Rock in October 2016, it struck me that this was the most diverse political gathering I’d ever seen.

Over 300 North American tribes had came together for the first time in history. Standing alongside them were over 100 Indigenous communities from all over the globe. A contingent from the Sami people, the Indigenous peoples of Scandinavia, had traversed the Atlantic to show their support the day I arrived. They were joined by black bloc anarchists, New Age spiritualists, traditional environmentalists, union organizers and ordinary Americans who have never attended a protest.

The media has characterized Standing Rock as a one-off protest against a pipeline in North Dakota.

But the reality is that the various movements from around the world including the Umbrella Movement in Hong Kong, the Pink Tide in Latin America, the landless people’s movement from India, the anti-austerity movement in Europe, the global Occupy movement, and the countless "awakenings" spreading across the African continent are uniting as expressions of the same impulse: a belief that the neoliberal capitalist system has failed the majority of humanity and a new world is emerging.

2. A more holistic activism is emerging
With its sacred fire, daily prayers and water ceremonies, Standing Rock has helped to reanimate the sacred aspect of activism. We are seeing a shift from resistance to resistance and renewal simultaneously. Progressive movements which once internalized the Neitzchean dictum that "God is dead" are now evolving their positions.

As the anarchist philosopher Hakim Bey states:
"As Capital triumphs over the Social as against all spiritualities, spirituality itself finds itself realigned with revolution."There is a shift to embracing a more holistic activism that transcends traditional Cartesian duality and calls upon greater forces. Cedric Goodhouse, an elder at Standing Rock put it simply, saying: "We are governed by prayer."
The particular ways in which Standing Rock embodied non-violent direct action has given many activists a new faith in the possibility of a more sacred activism. I stood with dozens of water protectors when they prayed on water in front of Energy Transfer Partners (ETP) engineers while they were laying down oil pipeline.

The very act of seeing Indigenous elders praying on water said more about the implications of an extractive pipeline than any linear argument. They dropped their tools not only because they wanted to avoid confrontation, but because somehow they understood they were on the wrong side of the moral calculus.

The author Charles Eisenstein reminds us of a powerful insight about sacred activism that has been embodied in Standing Rock: "We need to confront an unjust, ecocidal system. Each time we do we will receive an invitation to give in to the dark side and hate 'the deplorables.'

We must not shy away from those confrontations. Instead, we can engage them empowered by the inner mantra that my friend Pancho Ramos-Stierle uses in confrontations with his jailers: 'Brother, your soul is too beautiful to be doing this work.'

If we can stare hate in the face and never waver from that knowledge, we will access inexhaustible tools of creative engagement, and hold a compelling invitation to the haters to fulfill their beauty."

3. Occupation of space is a critical tactic
Even before Occupy there has been a renaissance in the political understanding of the value of place and space. The battlegrounds between the corporate/state nexus and people’s movements are physical realms: the places where resources are being extracted, water is being polluted and capitalist interests are expanding through what Marxist geographer, David Harvey, calls “accumulation by dispossession.”

The occupation of space creates a physical spectacle that forces the corporate media to tell the stories it would otherwise like to ignore. It creates networks of solidarity and deep relationships that span beyond the time and space of the occupation. It creates inter-generational transfers-of-knowledge, both politically and spiritually. It weaves the connective tissue for the continued resistance against corporate (and other imperialist) power.

Standing Rock will be remembered by the thousands of activists who braved blizzards to sleep in tipis, who cooked food together in the communal kitchens, and celebrated in song and ceremony with tribal elders around the sacred fire.

As the activist Reverend Billy Talen recently stated: "Zuccotti Park and the stretch of sidewalk in front of the Ferguson police department and the meadow near the Sacred Stone… these three places are lived in.

Here is where activists cared for each other and shared food, clothing and medicine. The force that upsets entrenched power the most is this compassionate living, this community in plain sight."

4. We are Nature protecting itself
Part of the on-going colonial legacy of North America is a battle between the mute materialism of capitalism that seeks to dominate nature and the symbiotic approach of Indigenous thought that sees Nature as alive, and sees human beings as playing a central role in the evolution and stewardship of the broader whole. It is this very worldview that rationalists derisively call “animist” and that continues to confound the utility maximization ideals of modern thought.

Indigenous lands are increasingly going to be a battleground not only for resource extraction, but ideology itself. Although Indigenous peoples represent about 4% of the world’s population they live on and protect 22% of the Earth’s surface. Critically, the land inhabited by Indigenous peoples holds the remaining 80% of the planet’s biodiversity.

It is no coincidence that ETP moved away from its early proposal to have the DAPL project cross the Missouri river just north of Bismarck, a primarily white city, to the Standing Rock area inhabited by the Sioux tribe.

During COP 21 in Paris, Indigenous youth groups carried banners that read: "We are Nature protecting itself." The idea that we are not protestors, but protectors of the sacred is a central theme that resonates throughout the world.

In a powerful article on the Sacred Stone blog, the camp’s founder Ladonna Bravebull Allard said: "This movement is not just about a pipeline. We are not fighting for a reroute, or a better process in the white man’s courts.

We are fighting for our rights as the Indigenous peoples of this land; we are fighting for our liberation, and the liberation of Unci Maka, Mother Earth. We want every last oil and gas pipe removed from her body. We want healing. We want clean water. We want to determine our own future."

These ideals are not just Indigenous ideals; they are ideals linked with our very survival as a species. In a world of catastrophic climate change, protecting the sacred must be the mantra of all activists and concerned citizens.

5. There is a common antagonist
Although the various social movements around the world are portrayed as separate incidents that are particular to their local context, there is a growing awareness among movements themselves that we are uniting against the same antagonist: the deadly logic of late-stage capitalism.

Whether one is fighting for land rights in India or tax justice in Kenya or to stop a pipeline in the US, the ‘enemy’ is the same: a cannibalistic global economy that requires perpetual extraction, violence, oppression, in the service of GDP growth, which in turn, benefits a tiny elite at the expense of the world’s majority.

There is a Algonquin word, wetiko, that refers to a cannibalistic spirit that consumes the heart of man. It was a common term used when the First Nations of North America initially interacted with the Western European colonialists.

The spirit of wetiko, like many memetic thought-forms, has mutated and evolved, and has now become the animating force of the global capitalist system. We are not just fighting a pipeline; we are fighting the wetiko spirit that has taken hold of our planet like invisible architecture.

What Standing Rock achieved so beautifully was to provide this broader context, to ladder up a local struggle for clean water to the struggle against the forces of wetiko itself. 

Wetiko is inherently anti-life. And what we are all fighting for is a new system that recognizes our interdependence with the Earth and with each other, and that allows our highest selves to flourish.

The sacred fire at Standing Rock may now be smoldering but it’s reverberations are only beginning to be felt. As Julian Brave NoiseCat poignantly states in his reflections on the impact of this historical movement:
 "They have lit a fire on the prairie in the heart of America as a symbol of their resistance, a movement that stands for something that is undoubtedly right: water that sustains life, and land that gave birth to people."
This is the enduring power of Standing Rock. It has created inextinguishable hope, activated our historical memory and created new forms of power by the profound act of starting a global movement from a single sacred fire.

The fires of Standing Rock are illuminating the transition that lies ahead and the new society that is emerging from its ashes.

The Dakota Access pipeline is set and oil will flow. But this is not the only fight about water, and Standing Rock is only one chapter somewhere in the middle of a long story. 

Every day I write rhymes on Twitter. I get a kick out of reducing complicated ideas and events down to 140 characters. So yesterday I wrote:

Powers That Be think it’s the endDAPL will now have much money to spendBut Standing Rock is a rally cryRebalance our world before we die

And that is the story I want to tell. Standing Rock is only one chapter somewhere in the middle of a long story.

It’s true that North Dakota used the power of the state this week to march into the camps along the Missouri River and round up the remaining water protectors.

But think about that story: A few dozen people were arrested at camps where more than 10,000 people once said no to the Dakota Access pipeline. That people power did not evaporate. Even today more people, tens of thousands, perhaps millions, are still a part of that effort via social media and through direct action.

The Standing Rock Sioux tribe and its allies have been repeating the same story for more than a year: Mni wiconi (water is life). This is a narrative that the state of North Dakota, the pipeline company, and the oil industry could not counter, despite spending millions of dollars and advancing into Great Sioux treaty lands with a law enforcement army.

The chief executive of the company behind the Dakota Access pipeline told investors on Thursday that he “underestimated the power of social media,” where stories spread so rapidly. According to Bloomberg News, Kelcy Warren complained:

 “There was no way we can defend ourselves.” 

Actually, there was a way: Many energy companies have figured out that it’s far better to work with communities than to roll over them.

The point is that the company and the state lost the narrative. But then, “lost” might not be the right word. The company was in a rush to build and North Dakota made the story more compelling by acting against its own interest.

Think about what story we’d be telling now if the North Dakota governor spent the first few weeks listening to the community and exploring alternatives. No one would have turned the page to see what happened next. No drama.

Instead, the county sheriff took center stage playing a villain. In August, Sheriff Kyle Kirchmeier arrested Standing Rock Chairman David Archambault II and the plot raced ahead to a military occupation, a company line to defend, and a global audience via social media. Lots of drama.

But this is not the only fight about water. There are now hundreds of scenes spread across North America.

The protection of water, the rebalancing of the world, now has a symbol and a memory to carry that story forward. Every pipeline project that’s planned across North America will have to defend itself in every community, on social media, and with investors.

The Standing Rock Sioux tribe hopes supporters on March 10th 2017 will march and pray in Washington, D.C. The tribe asks people to “rise in solidarity with the Indigenous peoples of the world whose rights protect Unci Maka (Grandmother Earth) for the future generations of all.” I think people will go. And by the thousands. Standing Rock is the call to action.

The White House tried to rewrite the story Thursday. Press Secretary Sean Spicer told reporters at the daily briefing that the White House is “constantly in touch with” the Standing Rock Sioux. The idea here, which has been brewing for a while, is to cast the tribe as a partner of the state.

The tribe immediately called out that statement as false. Archambault said in a news release: “We repeatedly asked for meetings with the Trump administration, but never received one until the day they notified Congress that they were issuing the easement.

I was on a plane to Washington, D.C., when the easement was issued. It was an insult to me and to the Tribe. I cancelled the meeting upon hearing this news. We have since filed a lawsuit for the immoral and illegal issuance of the easement and suspension of the environmental impact study.”

This lie from the White House is revealing: The Trump administration (and its allies in the oil industry and North Dakota) understands that this story is not over. They want their narrative back.

And that’s not going to happen. How could it? We all know water is life.

US vets defending NoDAPL

US veterans are returning to Standing Rock and pledging to shield indigenous activists from attacks by a militarized police force, another sign that the fight against the Dakota Access pipeline is far from over.

Army veterans from across the country have arrived in Cannon Ball, North Dakota, or are currently en route after the news that Donald Trump’s administration has allowed the oil corporation to finish drilling across the Missouri river.

The growing group of military veterans could make it harder for police and government officials to try to remove hundreds of activists who remain camped near the construction site and, some hope, could limit use of excessive force by law enforcement during demonstrations.

“We are prepared to put our bodies between Native elders and a privatized military force,” said Elizabeth Williams, a 34-year-old air force veteran, who arrived at Standing Rock with a group of vets late on Friday. “We’ve stood in the face of fire before. We feel a responsibility to use the skills we have.”

It is unclear how many vets may arrive to Standing Rock; some organizers estimate a few dozen are on their way, while other activists are pledging that hundreds could show up in the coming weeks. An estimated 1,000 veterans traveled to Standing Rock in December just as the Obama administration announced it was denying a key permit for the oil company, a huge victory for the tribe.

The massive turnout – including a ceremony in which veterans apologized to indigenous people for the long history of US violence against Native Americans – served as a powerful symbol against the $3.7bn pipeline.

But the presence of vets was not without controversy. Some said the groups were disorganized and unprepared to camp in harsh winter conditions, and others lamented that they weren’t following the directions of the Native Americans leading the movement.

Vets with post-traumatic stress disorder also suffered in the cold and chaotic environment without proper support, said Matthew Crane, a US navy veteran who is helping coordinate a return group with the organization VeteransRespond.

 His group has vowed to be self-sufficient and help the activists, who call themselves “water protectors”, with a wide range of services, including cleanup efforts, kitchen duties, medical support and, if needed, protection from police.

“This is a humanitarian issue,” said Crane, 33. “We’re not going to stand by and let anybody get hurt.”
On Friday afternoon, as snow rapidly melted during an unusually warm day in Cannon Ball, Jake Pogue helped organize a vets camp area at Sacred Stone, the first camp that emerged last spring in opposition to the pipeline.

“We’re not coming as fighters, but as protectors,” said the 32-year-old marine corps vet, noting that he was concerned about police escalating tactics. “Our role in that situation would be to simply form a barrier between water protectors and the police force and try to take some of that abuse for them.”

Since last fall, police have made roughly 700 arrests, at times deploying water cannons, Mace, rubber bullets, teargas, pepper spray and other less-than-lethal weapons. Private guards for the pipeline have also been accused of violent tactics.

“We have the experience of standing in the face of adverse conditions – militarization, hostility, intimidation,” said Julius Page, a 61-year-old veteran staying at the vets camp.

Dan Luker, a 66-year-old veteran who visited Standing Rock in December and returned this month, said that for many who fought in Vietnam or the Middle East it was “healing” to help water protectors.

“This is the right war, right side,” said Luker, a Vietnam vet from Boston. “Finally, it’s the US military coming on to Sioux land to help, for the first time in history, instead of coming on to Sioux land to kill natives.”

Luker said he was prepared to be hit by police ammunition if necessary: “I don’t want to see a twentysomething, thirtysomething untrained person killed by the United States government.”
LaDonna Brave Bull Allard, founder of the Sacred Stone camp and a Standing Rock tribe member, said she welcomed the return of the vets.

“The veterans are going to make sure everything is safe and sound,” she said, adding, “The people on the ground have no protection.”

At Standing Rock, indigenous activists say the mass arrests and police violence have led many of them to develop PTSD, suffering symptoms that many veterans understand well.

“This historical trauma of indigenous communities in this country is very real. It’s tragic,” said Crane. “The military has a lot of the same problems.”

Aubree Peckham, a member of the Mescalero Apache tribe who has been at Standing Rock for months, was in tears on Friday as she described the way indigenous water protectors have bonded with vets.

“We don’t know how to protect ourselves against the tactical weapons they are using,” she said. “They are getting us better prepared.”

Peckham said the affection was mutual: “We are able to talk about PTSD. And they finally feel like they are understood.”

Tribes divest DAPL bankers

The Navajo Nation is making moves to join a growing number of tribes that have already respectfully, but conclusively, shown Wells Fargo the door.

Like the call and response in Lakota ceremonial prayer songs, tribes are answering the Standing Rock’s Sioux plea for all of Indian Country to move its money out of banks that have invested in the Dakota Access pipeline and help further destabilize the pipeline’s already shaky financing.

“Many people are, rightfully, afraid that executive support [President Trump’s]now means that the pipelines are full steam ahead,” said Melanie Yazzie, co-founder of The Red Nation, an activist coalition dedicated to the liberation of Native people from capitalism and colonialism.

She views divestment as obstruction—the good kind—something akin to water protectors locking down on construction equipment and as a continuation of the widespread resistance that has united under the cry of #NoDAPL.

“The investors and financiers will not move forward if the projects are deemed financially unfavorable,” Yazzie said. “We must continue to deny settlers their desired profits, profits they reap from colonizing our non-human relatives—the land and water.”

That is the hope of a growing cohort of tribal leaders, activists, researchers, and strategists who have come to see divestment, which is catching on all across Indian Country, as a winning tactic in a wider strategy of non-cooperation. It’s a cohort that at first glance appears to have some strange bedfellows: radical academics and Wall Street professionals.

Since last August, when the Standing Rock Sioux severed their own relationships with DAPL-invested banks, financial adviser Lynn Rapp has been fielding a steady stream of questions from her tribal clients. She is managing director of Seacrest Investment Financial Management in Buffalo Gap, South Dakota.

“Tribes want to divest themselves as external supporters,” explained Rapp, who is Oglala Sioux. “It speaks really highly to their level of long-term commitment to the cause.”

The cause is mni wiconi, Sioux for “water is life,” or as some are now translating it: “water is alive.” And as Rapp sees it, it’s also about securing Indian rights.

“American Indians have to be able to stand up for what they believe about the environment, the economics of their time, and the social impact of situations like this,” she said.

Even in very poor nations like the Navajo, where 47 percent of the population lives below the poverty line, there are grassroots efforts to help move the divestment needle. Duane “Chili” Yazzie, president of the Shiprock Chapter of the Navajo Nation, has referred to the #NoDAPL struggle as the “ultimate stand for Mother Earth.”

He’s advocating for Speaker Lorenzo Bates, President Russell Begay, and Vice President Jonathan Nez to divest from Wells Fargo and all other DAPL-invested banks, beginning with the more than $2 billion in the Nation’s Permanent Trust Fund. In mid-December, the Shiprock Chapter and the Northern Navajo Agency Council passed resolutions that point to the dishonor and indignity of using Navajo money to lay waste to Mother Earth.

“The Diné people are the caretakers of the Earth in concert with people of good hearts around the world,” he explained. “I want to see my nation put some serious substance behind the verbal expressions of support for the Standing Rock Sioux.”

Or, as he put it more plainly: “Money talks.”

If this effort succeeds, the Navajo Nation will join a growing number of tribes that have already respectfully, but conclusively, shown Wells Fargo the door. The Nez Perce Tribe in Idaho and the Mille Lacs Band of Ojibwe in Minnesota have already severed fiscal ties, while the Alliance of Colonial Era Tribes, a consortium of tribes located along the East Coast, has indicated some of its members may soon do the same.

Of the U.S. banks, Wells Fargo is the second-largest financier of DAPL parent Energy Transfer, having committed $467 million to the family of companies, according to researcher Hugh MacMillan of Food & Water Watch. 

That includes $120 million directly to DAPL. So far, Wells Fargo has borne the brunt of divestments from Indian Country. (Citibank is the largest DAPL financier, having committed $521 million in credit to Energy Transfer, including $235 million directly to DAPL.)

In a written statement, Wells Fargo said it has been “serving Native American governments and communities for more than 50 years.” It provides financial services to more than 200 tribal and Native entities in 27 states, including many tribal community development projects. Over the past three years, the bank says, it has granted tribes $11 million, including $3 million for scholarships and educational programs though the American Indian Graduate Center.

Despite the longstanding relationships, what’s happened with DAPL changed everything for the tribes.

On the night of Nov. 20, when law-enforcement officers used tear gas and water cannons as part of their assault on unarmed water protectors, Janene Yazzie, a research associate in the Department of Soil, Water and Environmental Science at the University of Arizona, decided she could not remain silent. Armed with the Shiprock resolutions, she’s been actively lobbying the executive and legislative branches of Navajo Nation to divest.

“As a Navajo Woman,” she wrote in an email, “watching the videos on social media disturbed me to my core. They captured proof that the so-called ‘Indian Wars’ have never ended but are, rather, coming to a culmination.”

In Idaho, acting quickly after the Standing Rock Sioux’s call for divestment, the Nez Perce tribe withdrew millions from Wells Fargo on the grounds that the bank’s investment in DAPL was “inconsistent with the views and policies of the Nez Perce.” Mary Jane Miles, chair of the tribe’s executive committee, explained why they divested:
“I feel that tribal nations need to support each other in their efforts to remind the big companies of our stewardship responsibility. Our voice needs to be heard, and if there is any way that we can enhance our position we need to do so. The Nez Perce tribe supported their sister nation in other ways as well, such as tribal members voluntarily traveling to the site to camp in the bitter cold. The protest was well warranted in our worldview and was supported in all the ways we felt was necessary,” 
Miles wrote.
Rudolph Ryser, a member of the Cowlitz Tribe and board chair of the Center for World Indigenous Studies, a research and education organization, wants Indians everywhere to follow the lead of the Nez Perce.

“It is no longer tenable for the leaders of American Indian [tribes], Canadian Indian [tribes], and Indian leaders throughout the Americas to operate as if the leaders of hemispheric nations can or will act in responsible ways toward the indigenous people or the living earth.

Fourth World nations in the United States, Europe, Asia, and the Pacific are in a strong position to apply pressure on investors in the Dakota pipeline banks.”

Ryser hopes to see tribes act in unison for greater impact, banding together to “demand investment changes or withdraw funds.”

The nuts and bolts of divestment are easy to accomplish, Rapp explained.

“It’s very simple,” she said. “Establish an account with another financial institution that meets your political and social needs. The tribal council signs the transfer form, and it’s done. The new institution will request the funds be transferred, and that’s all there is to it.”

Lists of non-DAPL invested banks are being circulated, and Native-owned banks are being promoted as alternatives to the 17 U.S. banks invested in DAPL.

The Standing Rock Sioux continue to encourage and applaud divestment. On Jan. 16, Indigenous Environmental Network released a focused statement on recent efforts to influence DAPL banks to renegotiate or cancel their loans. It's likely to rev up the divestment engine. A billboard in Times Square broadcasts the rolling tally of self-reported dollars already divested (more than $55 million now); it's also reported on the Defund DAPL website.

Meanwhile, cities of varying sizes are pursuing divestment, including Seattle, where a final vote is scheduled Monday. It would make Seattle the first municipality to divest over Dakota Access, but it’s a trend that’s occurring in the context of a worldwide fossil-fuel divestment movement.

According to a recent Arabella Advisors report, “The Global Fossil Fuel Divestment and Clean Energy Investment Movement,” as of December 2016, institutions and individuals with assets over $5 trillion have committed to divest from fossil fuels.

Longtime White Earth Ojibwe activist Winona LaDuke of Honor the Earth wrote a letter to Canadian energy giant Enbridge, noting that the company hasn’t yet put in some $1.3 billion toward the pipeline.

“They're sitting on it,” she said. “This is the pipeline that doesn’t have all its needs for capital met.”
Native prophecies speak of a choice, LaDuke said, “between a well-worn, scorched path, and a new path, which is green. This scorched path is a path of violence, a path of billions of dollars of oil infrastructure we don’t need, and the new path is the path of peace.”

“And that’s what this moment is,” she continued after a pause. “We can ensure we have a future where they can’t harm us all.”
